Tim Sullivan recently presented a program on the Challenges Involved in Elder Claims at the Western Claims Conference at the Esmeralda Resort in Indian Wells, California. The presentation was designed to assist in educating claims representatives who handle life, health, disability and annuity matters as to the unique issues which arise in claims presented by senior citizens.
After reviewing the history of the development of laws designed to prevent the exploitation of the elderly, Tim discussed specific recommendations for proper handling of claims in which trustees, guardians, powers of attorney and conservators are involved. In addition, he reviewed the disputes that arise concerning suitability of products sold to seniors and the state laws regulating annuity sales in particular. The program also addressed special handling of unusual issues created by changes of beneficiary, agent misconduct and policy lapse in matters involving seniors.
