On November 30, 2005, the Supreme Court of Florida heard oral arguments on a Florida Bar petition seeking an amendment to Rule 4-1.5(f)(B) of the Rules of Professional Conduct in response to the recently enacted Amendment 3 (Claimant's right to fair compensation).
Before taking final action on the pending petition, the Court directed the Florida Bar to select a Special Committee to draft this amendment. Randy Ogden was appointed to this 12 person statewide committee that was chaired by former Florida Supreme Court Justice Major B. Harding.
The final amendment was recently approved by the Florida Board of Governors. The Florida Supreme Court has directed the Florida Bar to solicit comment by publishing the amendment in the March 15th edition of the Bar News.
